Are you a Tier 1 Entrepreneur Visa holder but unable to qualify for indefinite leave to remain? Contact us – we can help!
If you are a Tier 1 (Entrepreneur) migrant and have been unable to obtain Settlement status due to excessive absences or not meeting the strict requirements, you can now switch to the Turkish Businessperson visa and become eligible for Indefinite Leave to Remain.
Since the Tier 1 (Entrepreneur) route closed, many people will not be able to apply for Indefinite Leave to Remain before the deadline of 05 April 2025, meaning their years of residence and hard work may be lost. However, if you hold a Turkish passport, you can switch to the Turkish Businessperson visa and include the time you have spent as a Tier 1 (Entrepreneur) towards your 5 years residence needed for settlement in the UK.
Switching to the Turkish Businessperson visa could be your plan B, your lifeline to securing settlement in the UK. If you are a Tier 1 (Entrepreneur) struggling to meet the requirements, or are just wishing to switch to the Turkish Businessperson route, we would recommend that do so promptly. This is due to the Turkish Government having recently announced that in light of current circumstances, applications from outside the UK are suspended until 20 April 2020.
The Turkish citizenship program offers a fast-track second passport through €250,000 real estate investment, with no additional donation required.
This route is far more cost effective in terms of overall capital requirements, compared to other programs, such as the Cyprus Citizenship and UK Tier 1 (Investor) routes. Once Turkish citizenship is obtained, the investor can relocate to the UK with a business visa known as the Turkish Businessperson Visa.
This is possible due to the Ankara Agreement, allowing Turkish passport holders to establish businesses or become self-employed in the UK and in turn, get residency rights. After 5 years of residing in the UK as a Turkish Businessperson, you will be able to settle permanently in the UK and apply for British Citizenship shortly after.
If you are a current Tier 1 (Entrepreneur) visa holder, but struggling to meet the strict requirements, then this program is your solution! The time that you have already spent as a Tier 1 (Entrepreneur) can be counted towards the 5 years you need to apply for settlement.
Ankara Agreement leading to Settlement in the UK
The European Communities Association Agreement (ECAA), also known as the Ankara Agreement, lets Turkish citizens establish themselves as workers in the UK, or to establish a business. In doing so, you will be issued with a visa permitting you to live in the UK and bring your partner and children with you.
You can obtain settlement status by meeting the following requirements:
- You have had 5 years continuous UK residence (no more than 180 days absences in 12 months);
- Your last granted leave was as a Turkish Businessperson;
- You have sufficient knowledge of the English language and life in the UK;
- You continue to run the business relied upon to be regarded as a Turkish Businessperson and you intend to continue running a viable business in the UK;
- You have been able to support yourself and any family members without recourse to public funds; and
- You do not fall for refusal under the general grounds for refusal.
However, as a result of Brexit, the Turkish Businessperson visa will only be available until the end of the transition period, which at present is due to end on 31 December 2020. Therefore, you must begin this process immediately so you do not miss out on this opportunity.
If you are a Tier 1 (Entrepreneur) migrant unable to obtain settlement under this category,, this is your last chance to switch to the Turkish Businessperson visa and not let your hard work and years residence go to waste.
If you are considering this route, we advise on acting promptly and beginning this process immediately to ensure that you are not impacted by factors such as Brexit or the Coronavirus.
